General Terms and Conditions

  1. Paying persons are referred to as passenger(s) in this document, unless otherwise agreed in writing, all charter trips are sold based on the following terms and conditions of the purchaser and no agent or representative has the authority to vary or omit part or all of, these conditions.
  2. The Promoter is Sydney Adventure Cruises, Sydney Boathouse Complex, James Craig Road, Rozelle, NSW 2041 – ABN 21 124 573 815. Telephone: 02 9818 6111.
  3. All cruise fares are quoted in Australian Dollars and include Australian Goods and Services Tax.
  4. At the time of booking a cruise, you must pay for it in full. Once booked and paid for, all cruise tickets are 100% non-refundable but may be transferred at our discretion or if otherwise specified. Any requests to transfer a booking to another date or time must be made 72 hours prior to the cruise time, are subject to availability in the class and any promotional price of your booking will incur a $10 transfer fee for each time a request is made.   5. Cruises agrees to any transfers to a different class or promotional price, you must pay the difference between the original booked price and the price of any transferred booking. No agreement will arise between you and us until Sydney Adventure Cruises have received payment at the time of booking in accordance with this clause.
  6. Sydney Adventure Cruises operates cruises on busy waterways and are subject to the risks and perils of cruising on such waterways including loss, damage and injury arising out of or in connection with changing tidal and weather conditions and the navigation of other craft. To the extent permissible by law, Sydney Adventure
  7. Cruises will not be responsible in tort, contract or otherwise for any loss or damage arising out of injury or death sustained by you or any other passenger, howsoever arising and whether or not arising as a result of our negligence or failure to render due care and skill. You enter into this agreement and book and travel on our cruises at your own risk. If however any guarantees, terms, conditions or warranties are implied into this agreement by any law of the Commonwealth or New South Wales, the exclusion of which would contravene that law or cause part or all of this clause to be void, then to the extent permissible by law:
    (a) We exclude all other guarantees, terms, conditions and warranties; and
    (b) Our liability for breach of such guarantee, term, condition or warranty is limited to the supply of the relevant cruise again or the cost of re-supplying the cruise.
  8. Sydney Adventure Cruises can cancel or vary cruise information without notice. If Sydney Adventure Cruises cancel the cruise, a full refund or credit will be provided.
  9. Cruise tickets are available for pre-booking only. Sydney Adventure Cruises require full payment at time of booking to confirm and secure your place on a charter. Please note that failure to make due payment in respect of bookings or instalments shall entitle Sydney Adventure Cruises to consider the booking cancelled. All effort from Sydney Adventure Cruises will be made to contact you before the booking is made available to other parties, however should contact not be made, Sydney Adventure Cruises is entitled to consider the booking void and release the place to another person.
  10. Sydney Adventure Cruises reserve the right, if we consider necessary (for example, due to mechanical breakdown, for safety reasons or weather conditions), to substitute vessels without notice (including any vessels of a third party), deviate from a vessel’s advertised route, change any menu, service, schedule, program, performance or cruise fare. Sydney Adventure Cruises will endeavour to provide a similar quality vessel, route, menu, service, schedule, program, performance or cruise fare (as the case may be) in these circumstances. In such circumstances, we will not be liable for your direct or indirect loss, or to refund any fares or portions of fares, nor will we be liable for any other damage, loss, expense, loss of time, disappointment, inconvenience, or any other consequential loss suffered by you.
  11. Sydney Adventure Cruises will make every effort to cater for your special dietary requirements and allergies. If you have any special dietary requirements please inform our reservation staff upon placing your booking. However, Sydney Adventure Cruises cannot guarantee that certain products will not be in our food, and we explicitly accept no liability. For serious food allergies you must make your own decisions on selecting meals. Our staff’s comments are only to assist you in making an informed decision. In exceptional circumstances, with our prior written consent you (or one of your guests) may bring your own meal.
  12. Sydney Adventure Cruises excludes all liability for any loss or damage to clothing or personal items/belongings howsoever arising and whether or not our liability arises in tort, contract or otherwise.
  13. It is a condition of this agreement that any claim for loss or damage must be notified to Sydney Adventure Cruises in writing within seven (7) days from the day the cruise finishes, and any court action, suit or proceeding must be brought no later than one (1) year from the same day. If you fail to comply with either of these conditions, Sydney Adventure Cruises will be forever discharged from all claims, suits, actions and/or proceedings relating to or arising out of or in any way connected with the cruise and we will be discharged from all liability whatsoever, including any liability for negligence.
  14. Sydney Adventure Cruises may contract or arrange for third parties to provide the whole or part of the cruise and any related services to you. You must not bring any claims or actions against such third parties. If you bring such a claim or action in breach of this agreement, you agree to indemnify Sydney Adventure Cruises and the person against whom the claim or action is made against the consequences of that claim or action. You agree that in entering into this agreement, Sydney Adventure Cruises are acting as the agent of and trustee for each of our employees, officers, agents and subcontractors, and each of these persons is deemed to be a party to the contract for the purpose of entitling each of them to enforce, have the benefit of and rely upon these Terms and Conditions.
    Sydney Adventure Cruises reserves the right to refuse to carry any passenger, luggage or goods without assigning any reason thereof.
    Passengers are not permitted to bring on-board any alcoholic liquor, matches, explosives, volatile spirit or other goods of a dangerous, inflammable, illegal substances or offensive nature. In the event of a passenger being required not to embark or disembark from the vessel under the provisions of this condition, Sydney Adventure Cruises is not under any liability of any kind to such passenger. Sydney Adventure Cruises reserve the right to refuse you entry to the vessel, or to require you to disembark from the vessel, including due to your intoxication or for the safety of other passengers or the vessel.
    Australian law requires you to be 18 years or over to be served alcoholic beverages. At no time will any person exhibiting the following, be admitted onto, or served alcohol on the vessel: is intoxicated (as per the RSA); is aggressive, quarrelsome or disorderly; is, or is suspected of being, under the influence or in possession of illicit substance; is found soliciting from passengers or staff.  Sydney Adventure Cruises reserve the right to refuse admission/boarding to any passenger deemed to be in breach of the NSW RSA guidelines, in this instance NO REFUND will be given in part or full.
    This agreement is to be governed by and is to be construed in accordance with the laws in force in New South Wales. Any action, claim, suit or proceeding arising out of or connected in any way with this agreement or the cruise will only be brought in the Courts of New South Wales.
  15. If any of these provisions are unenforceable, this shall not affect the enforceability of any other part of the provision or any other provision. In the event of inconsistency between these Terms and Conditions and any other terms, these Terms and Conditions will prevail to the extent of the inconsistency. No waiver or variation of this agreement will have binding effect unless such waiver or agreement is in writing and signed by us.
  16. Group discounts are not available unless otherwise specified.
  17. No amount is refundable or transferable for cancellations and no shows, unless otherwise specified.
  18. All breakages and damages caused by an individual passenger or group must be paid for.
    Sydney Adventure Cruises does not accept BYO alcohol and the consumption of alcohol will be monitored in line with the Responsible Service of Alcohol act.
  19. Passengers must be ready at the point of departure stipulated within fifteen (15) minutes of the departure time.
  20. Photographers are working on all event cruises. By accepting or receiving this ticket, the passenger agrees photographs are Sydney Adventure Cruises property. Photographs from our events may be published in – but is not limited to – electronic newsletters, advertorials, editorials, advertisements, internet, intranet, magazines, reports, displays, posters and brochures without any compensation or recognition given. If you have been photographed and do not wish for it to be used, please notify the official cruise photographer immediately, if you wish for a photo to be removed from any digital media contact us on

  21. If, in the opinion of the master of the vessel, the voyage cannot be continued for any reason, then the master may terminate the cruise at any time. Sydney Adventure Cruises management reserves the right to terminate the service and/or disembark passengers at the nearest wharf.
  22. Payment for any Sydney Adventure Cruises experience constitutes acceptance of the associated terms and conditions. By accepting or receiving this ticket, the passenger agrees to the other provisions hereof and both on his or her behalf.

Whale Watching Terms and Conditions

  1. Whale guarantee – if you do not see a whale on while on our whale watching cruise, you will receive a free cruise within the same whale watching season, subject to availability. Passenger’s stamped original cruise ticket is provided as proof of re-booking on your next cruise. Our guarantee is available only to Sydney Adventure Cruises whale watching passengers – tickets are not transferrable.
  2. Sydney Adventure Cruises whale watching cancellation and rescheduling policy applies. The policy is detailed below.
  3. Cruises are non-refundable due to seasickness – please visit your local Pharmacy or Natural Health Food Store. Sydney Adventure Cruises also advise passengers pack a warm jumper and waterproof jacket and wear fully covered shoes.     Preventing Sea Sickness
    Sea sickness is a horrible feeling and because we’re going out to sea, we encourage all our customers to prevent this as best they can. Don’t let sea sickness spoil your day, visit your local pharmacy or Natural Health Products Store prior to the cruise. For more information on how to prepare for sea sickness and what to bring when whale watching with Sydney Adventure Cruises, please visit our website at www.sydneyadventurecruises.com.au. NO REFUNDS ARE GIVEN FOR SEA SICKNESS.

Whale Watching Cancellation and Rescheduling Policy

Sydney Adventure Cruises brings you the most exciting whale watching experience in Sydney – taking you out in the open ocean to get up close to the majestic beauties of the sea. To give you the best possible experience, cruises are dependent on weather and sea conditions to ensure your safety and comfort.
Sydney Adventure Cruises reserves the right to cancel cruises due to inclement weather and rough sea conditions. If for any such reason a cruise is cancelled, Sydney Adventure Cruises will rebook your whale watching cruise, with no additional charge, or we will provide a full refund of your ticket.
In the case of Sydney Adventure Cruises cancelling a whale watching cruise, all customers will be notified via email as soon as the decision has been made. Customers are asked to call the hotline on (02) 9062 3623 after 8.30am on the day of their scheduled whale watching cruise to confirm if a cruise is going ahead.
If for any reason you cancel your booking within 24 hours of your scheduled cruise – NO REFUND will be provided.
If for any reason you cancel your booking within 48 hours of your scheduled cruise – you will receive a 50% refund of your whale watching ticket value.
If for any reason you cancel your booking more than 48 hours prior to the departure of your scheduled cruise – you will receive a full refund of 100% of your whale watching ticket value. Should you wish to change your cruise booking to another cruise, a $10.00 administration fee will apply.

 
New Years Eve Terms and Conditions

  1. Cruise date is 31 December 2014.
  2. Strictly no alcohol is allowed on a Sydney Adventure Cruises vessel – Sydney Adventure Cruises accepts no BYO under any circumstances. Sydney Adventure Cruises management reserves the right to terminate the service of alcohol if patrons appear intoxicated and/or disembark patrons at the nearest wharf. We don’t serve shots, slammers or doubles. The service of alcohol will be monitored. Bar service will cease 10 min prior to disembarking.
  3. Passengers wishing to embark on the New Years Even cruise must board from Eastern Pontoon, Circular Quay or another wharf as nominated by Sydney Adventure Cruises. Departure is 7pm Sharp.
  4. Passengers on the Family Picnic Cruise are entitled to bring picnic food and snacks as well as non-alcoholic beverages including but not limited to soft drink, juice and water.
  5. Booking changes require an administration fee of $10.00 – which includes changes to passenger names or travel numbers.
  6. Tickets are non-refundable under any circumstances. Cancellations for a 50% refund must be made two months prior to the cruise or no refund will be given. No refund will be given for a cruise that is missed, no matter what the circumstances.
  7. Full payment is required at the time of booking, tickets and moneys are not transferable and not refundable. No amount is refundable for cancellations and no shows. Pre-booking only.
  8. Bookings are not accepted for children under 5 years old.
  9. Group discounts, children discounts and pension discounts are not available.
  10. All breakages and damages must be paid for by the passenger or group who caused it.
  11. Sydney Adventure Cruises does not accept any liability for the cancellation or postponing of any special events nor for weather conditions that may impede viewers from seeing the fireworks.
  12. Sydney Adventure Cruises reserves the right to a) change any price b) amend or cancel a service, route or other information c)substitute any vessel referred to in this brochure if it sees is necessary without notice and without incurring liability.
  13. In the unlikely event that Sydney Adventure Cruises cancel their New Years Even Cruises, all passengers are entitled to a full refund of their ticket price.

Australia Day Terms and Conditions

  1. Cruise date is 26 January 2015.
  2. Strictly no alcohol is allowed on a Sydney Adventure Cruises vessel – Sydney Adventure Cruises accepts no BYO under any circumstances. Sydney Adventure Cruises management reserves the right to terminate the service of alcohol if patrons appear intoxicated and/or disembark patrons at the nearest wharf. We don’t serve shots, slammers or doubles. One drink per person. The service of alcohol will be monitored. Bar service will cease 10 min prior to disembarking.
  3. Passengers wishing to embark on the Australia Day cruise must board from Eastern Pontoon, Circular Quay or another wharf as nominated by Sydney Adventure Cruises.
  4. Booking changes require an administration fee of $10.00 – which includes changes to passenger names or travel numbers.
  5. Tickets are non-refundable under any circumstances. Cancellations for a 50% refund must be made two months prior to the cruise or no refund will be given. No refund will be given for a cruise that is missed, no matter what the circumstances.

  11. In the unlikely event that Sydney Adventure Cruises cancels their Australia Day Cruises, all passengers are entitled to a full refund of their ticket price.

 Boxing Day Terms and Conditions

  1. Cruise date is 26 December 2014.
  2. Strictly no alcohol is allowed to be brought on board or to be taken off board a Sydney Adventure Cruises vessel. Sydney Adventure Cruises accepts no BYO under any circumstances. Sydney Adventure Cruises management reserves the right to terminate the service of alcohol if patrons appear intoxicated and/or disembark patrons at the nearest wharf. We don’t serve shots, slammers or doubles. One drink per person. The service of alcohol will be monitored. Bar service will cease 10 min prior to disembarking. Alcohol is not to be taken off the boat.
  3. Passengers wishing to embark on the Boxing Day cruise must board from Eastern Pontoon, Circular Quay or another wharf as nominated by Sydney Adventure Cruises.
  4. Boxing Day – BYO Picnic Cruise is not a catered cruise. Passengers embarking on this cruise are invited to bring their own picnic lunch, snacks and non-alcoholic beverages including water, juice or soft drink, or purchase drinks from the licensed bar.
  5. Booking changes require an administration fee of $10.00 – which includes changes to passenger names or travel numbers.
  6. Tickets are non-refundable under any circumstances. Cancellations for a 50% refund must be made two months prior to the cruise or no refund will be given. No refund will be given for a cruise that is missed, no matter what the circumstances.
  7. Full payment is required at the time of booking, tickets and moneys are not transferable and not refundable. No amount is refundable for cancellations and no shows. Pre-booking only.
  8. All breakages and damages must be paid for by the passenger or group who caused it.
  9. Sydney Adventure Cruises does not accept any liability for the cancellation or postponing of any special events nor for weather conditions that may impede viewers from seeing the Sydney to Hobart Yacht race.
  10. Sydney Adventure Cruises reserves the right to a) change any price b) amend or cancel a service, route or other information c) substitute any vessel referred to in this brochure if it sees is necessary without notice and without incurring liability.
  11. The picnic cruise component is dependent on weather and sea conditions. If conditions are too rough or dangerous, the Boxing Day Cruises will continue in the Harbour only. No refunds will be given in this event.
  12. In the unlikely event that Sydney Adventure Cruises cancels their Boxing Day Cruises, all passengers are entitled to a full refund of their ticket price.
